ABSTRACT

Where the claim is for a specified amount of money, if judgment in default is entered, the claimant may specify in the request whether he wants payment to be made immediately or by a specified date, or may specify the time and rate of payment by instalments (r 12.5(1)). As a judgment in default for a specified amount will entitle the claimant to seek immediate payment of the amount claimed from the defendant, without the need for any further assessment, it is often referred to as judgment for a ‘final amount’.
