O’Donnell v O’Donnell (1975) CA H and W were married in 1960; they had three children. In 1972 they were divorced after H left W. H was employed by his father, a successful businessman and held shares in family companies, including a hotel business, in the development of which W had played an important role. W applied for maintenance and the judge, applying the ‘one-third rule’ awarded W a lump sum payment. H appealed against the size of the sum.
