ABSTRACT
Martin v Martin (1977) CA H and W were married in 1957; the matrimonial home was bought in H’s name. H left W in 1972 so as to live with another woman and W remained in occupation of the matrimonial home. Following divorce in 1974, W continued to reside in the matrimonial home, and sought a property adjustment order. The court ordered that the house be held upon trust for W for life or until remarriage or her voluntary departure. H appealed.
