ABSTRACT

The question principally deals with two of the four characteristics which enable us to compare our constitution with other constitutions. Whereas ‘parliamentary sovereignty’ has particular application to the UK citizen and our legislature and the ‘rule of law’ to the UK citizen and our State, ‘separation of powers’ and ‘independence of the judiciary’ will require a consideration of the relationship

between our legislative and the executive branches and the relationship between these two branches of government and the judiciary, both in terms of parliamentary sovereignty and judicial review.
