ABSTRACT
When construing express warranties, the courts, occasionally, adopt contra proferentem rule. The meaning of this rule has been explained by Staughton LJ, in Youell v Bland Welch & Co Ltd:41
… in case of doubt, wording [in a contract] is to be construed against the party who proposed it for inclusion in the contract: it was up to him to make it clear.
