ABSTRACT

An Inchmaree Clause56 significantly expands the hull insurer’s undertaking, by specifying coverage for a variety of perils in addition to the ones specified in the traditional language of the standard form policy – that is, perils of seas, fire, jettison, piracy. The Inchmaree Clause, which appears in standard Institute Clauses, provides cover for perils, some of which are excluded by s 55(2)(c).57 However, under the Inchmaree Clause, any loss caused by a lack of due diligence on the part of the assured or his servants is excluded from coverage.58
