This chapter explains how to construct the drafting of pleadings and a letter of advice to the client who wishes to seek compensation for her personal injuries.

At any time accidents occur and not unnaturally the person who is injured will look for someone to blame for the accident. The first job the lawyer must do, when approached for advice, is to examine the facts surrounding the accident and come to a conclusion as to whether the responsibility for the accident can be placed on someone else. It is important to remember that some accidents are just that – accidents, and there may be no possibility of recovering compensation because there was no negligence. However, the doctrine of res ipsa loquitur may help to prove negligence if your client can remember nothing and finding proof of negligence is difficult or impossible.
