ABSTRACT

Where a defendant gives evidence, he must do so on oath or affirmation and he will be liable to cross-examination.11 His testimony will be evidence at the trial for all purposes. Thus, he may incriminate himself in the witness box and anything he says there may be used as evidence against any co-defendant.12 Counsel for the prosecution is entitled to cross-examine with a view to incriminating not only the defendant giving evidence but a co-defendant also.13 The defendant who gives evidence may also be cross-examined on behalf of any co-defendant.
