ABSTRACT
Under this provision a defendant who gives evidence may be questioned about the matters referred to in the opening words of s 1(3) where he has given evidence against any other person charged in the same proceedings.66 There is no discretion to disallow a co-defendant’s application to crossexamine under s 1(3)(iii), so argument in court will generally be confined to the question of whether the appropriate situation has arisen.
