ABSTRACT

Lord Lane CJ: ... The facts of the case, which are not in dispute, were these. In the early hours of 31 January 1985 the appellant entered a house in South East London, almost certainly in search of money and valuables, though such an intent, namely the intent at the time of entry to steal, was not alleged against him. At the time of that entry he was unarmed. He looked round the house downstairs. It seems he found nothing there which interested him, except a kitchen knife with which he armed himself.
