ABSTRACT

Wherever the application of the principles of free movement enshrined in the EC Treaty is insufficient to remove restrictive barriers (for example, where national restrictive measures are justified under Community law), secondary legislation is necessary. The aim of the legislation is to establish an equivalent level of protection of the public interest objectives (for example, consumer protection, protection of minors, protection of public health) in order to remove the legal barriers which make for disparities between national regulations. Some existing directives are relevant to commercial communications. They concern, inter alia, misleading advertising,19 foodstuffs,20 financial services,21 medicinal products,22 data protection,23 and television broadcasts.24
