ABSTRACT

The law takes the view that such agreement needs to be supported and it will be seen from other sections of the Act that the level of support provided from both the Act and the ability of the courts to support and strengthen the inherent powers of the arbitrator are much more than is generally reckoned. In general terms it can be stated that the courts will not, without good reason, interfere with either the conduct of the proceedings or the award, and they will support the arbitrator if and when required by providing additional powers should they be required.
