ABSTRACT
If the accident happened in Italy but the defendant is domiciled elsewhere, there are a number of options. Proceedings can be commenced in either the place of domicile of the defendant, the place of the accident, the place where the defendant insurer has its registered office, or the place of the branch office or agent which executed the insurance contract. Either party has the right to ask for the proceedings to be transferred to another court if it can be proved that the appointed court is not competent.
