A union will assist a member in either bringing or defending an action if an accident or disease is caused by work, and also in road traffic cases.
Scottish criminal courts are empowered to award compensation for personal injuries. No formal application by the victim is required. The awarding of damages by the criminal court does not prevent a subsequent civil claim being made. The criteria differ from the assessment of a civil award in that they are tariff based.
