ABSTRACT
Mr Gerhard Süßmann worked as a physicist in research institutes whose remuneration and pension system was the same as that of the civil service. He retired in 1980. Following amendment to the Supplementary Pensions Fund which administered the supplementary old-age pensions scheme, the Federal Court gave judgment in a series of test cases. The applicant appealed to the Arbitration Tribunal of the Supplementary Pensions Fund, challenging, inter alia, the legality of the amendments made to the rules governing the pension scheme. He complained of the length of proceedings. Comm found unanimously V 6(1).
