Claiming in tracing cases: trusts and remedies

Having considered the nature of the tracing claim, it is important to consider the forms of remedy which might be imposed as a result of it. The two principle remedies are the charge (Re Tilley) and the constructive trust (Westdeutsche Landesbank); although resulting trust (El Ajou), equitable compensation (Target Holdings) and subrogation (Boscawen) are also possible on the basis of recent cases.
