ABSTRACT

Certain contracts are said to be illegal. ‘Illegal’ in this sense does not mean that the contracts themselves are unlawful under the criminal law or even that they necessarily involve the commission of a criminal offence, though some contracts in this category will, no doubt, amount to criminal conspiracies. It simply means that the law regards the purpose of the contract to be unworthy and will, therefore, not lend itself to the enforcement of the contract.
