ABSTRACT

Regulations passed in pursuance of an EU Directive lay down duties for a ‘commercial agent’ which are more or less on a par with those which were established by English law. However, ‘commercial agent’ as defined applies only to ‘a self-employed intermediary who has continuing authority to negotiate the sale or purchase of goods on behalf of another person (‘the principal’) or to negotiate and conclude the sale or purchase of goods on behalf of and in the name of the principal.
