Production of documents The Department of Trade and Industry may require a company to produce documents (s 447 CA 1985). This power is reinforced by a power of entry and search (s 448 CA 1985). This is often the precursor to an investigation. Investigation of affairs of a company Section 431 CA 1985 provides that the Secretary of State may appoint inspectors to investigate a company’s affairs on the application of not less than 200 members or of members holding not less than 10% of the issued shares or, in the case of a company without share capital, one fifth of the members or the company itself. The application must be supported by such evidence as the Secretary of State may require.
