ABSTRACT

Held Because of the position he enjoyed, the acts of the managing director in managing the ship could be seen as the acts of the company. The appellant company was responsible for his acts and defaults and so the company could not escape liability by relying on the statutory defence.

Tesco Supermarkets Ltd v Nattrass (1972) HL The appellant company was charged with an offence under the trade descriptions legislation of displaying inaccurate price information in one of its stores. The company was convicted and fined but appealed on the basis that the company had not committed the offence – it had in place a management and supervisory system designed to prevent this type of offence and the failure that resulted in the offence being committed was the failure of the store supervisor, which should not be attributed to the company.
