ABSTRACT
You should have a clear knowledge of the differences between Arts 81 and 82 and the role each plays in the competition policy of the EU.
More specifically, you should understand the following points: • the type of agreements dealt with by Art 81; • the possible exemptions under Art 81; • the meaning of dominant position under Art 82; • the control of mergers within the EU; • the sanctions for anti-competitive behaviour; • the control of public anti-competitive behaviour under Arts 87 and 88; • the role and powers of the European Commission; and • the remedies available, including those provided by the national courts.
