ABSTRACT

It will sometimes suit a party to break their contractual obligations and pay damages; however, through an order for specific performance, the party in breach may be instructed to complete their part of the contract. An order of specific performance will only be granted in cases where the common law remedy of damages is inadequate. It is not usually applied to contracts concerning the sale of goods where replacements are readily available. It is most commonly granted in cases involving the sale of land, where the subject matter of the contract is unique.
