Two key phrases are central to this section. They are ‘licensable conduct’ and ‘designated activities’. Licensable conduct under sub-s (1) applies to security work (designated activities) attributable to those categories of people who will need to be licensed by the Authority. These constitute a range of activities defined under this section as well as Sched 2 to the Act, which will be examined in detail below. Designated activities under sub-s (3) refer to specific activities applicable to security operatives which the Home Secretary may apply to licensable conduct in the future. Sub-section (1) also makes the important provision that it will be an offence for a person to engage in any licensable conduct without a licence or, even if they possess one, it will be an offence to engage in any licensable conduct which is not covered under the licence.
