ABSTRACT
This chapter considers express trusts: that is, situations in which the settlor intends to create a trust. Alternatively, it might be, in some cases, that the court analyses the actions of the settlor as evidencing an intention to create an express trust, even though she might not have understood the legal concept of the ‘trust’. Our concern
is therefore to examine the rules governing whether or not there is a valid express trust.
