In divorce proceedings the Petitioner makes all the running, pays the court fees (though they may claim them back from the Respondent) and does the lion’s share of the form-filling.

We hope that the divorce petition does not come to you out of a clear blue sky. In an ideal world you and your spouse will have discussed arrangements for any children in advance, and possibly even have agreed on which ‘fact’ (see p 7) to use in the petition. However, rather than take such things for granted, the guide below assumes that you have not agreed anything in advance.
