ABSTRACT

The same would apply if Polly was the sole owner: the rules are unisex. We first mentioned this briefly in ‘Protecting the family home’ on p 27. Now here is a more detailed explanation.

As long as Polly continues to live in the family home, with or without Paul, she has a legal right under the Matrimonial Homes Act 1983 to stay there until the court orders otherwise, or grants a Decree Absolute in her divorce. Until then, Paul cannot make her leave the family home, provided that: ❍ she was living there with Paul while she was

married to him; and ❍ she continued to live there without interruption,

despite the breakdown of her marriage.
