ABSTRACT
Although insanity may also be an issue where the defendant has been remanded in custody, or at the beginning of the trial itself, most undergraduate courses concentrate on
insanity in relation to the defendant’s mental state at the time of committing the offence. It is insanity as a defence at the trial which is discussed below.
