ABSTRACT
Proportionality is a concept developed in continental jurisdictions rather than by the common law, and involves the premise that a sledgehammer should not be used to crack a nut, so that the measures used to achieve a particular end must be no more than necessary to achieve that end. It did not formally enter English law until the Human Rights Act 1998 came into force, but some movement in this direction can be detected before that date.
