ABSTRACT
In England this dispute has clearly been resolved by the decision of the House of Lords in Foskett
v McKeown,3 where the majority recognised a fundamental distinction between the law of unjust
enrichment and the law of property, and held that a claim to recover substitute property in which
the claimant asserted an equitable proprietary interest depended on the vindication of property
rights and not unjust enrichment.
