ABSTRACT

The law of privilege allows a person from whom information is sought to resist what would otherwise be a compulsory request for disclosure. This chapter covers the most important forms of privilege and immunity recognised at common law or under the uniform evidence legislation, namely:

• legal professional privilege;

• the privilege in aid of settlement;

• the privilege against self-incrimination;

• public interest immunity;

• privilege in other confidential relationships; and

• sexual assault counselling privileges.
