ABSTRACT

The previous chapter examined how evidence of a person’s behaviour following an alleged crime can play a significant role in the prosecution’s case against that person. Such behaviour can arise independently of a criminal investigation; however, investigators will often manipulate events so that they can witness, or even prompt, guilty conduct by the defendant. This chapter examines when conduct obtained in this way (or, at least, such conduct that falls within the category of ‘admissions’) is admissible.
