ABSTRACT

There is no general enforceable right to enter, remain in or move freely about in the UK or travel abroad except in so far as the freedom of movement provisions of EU law apply, and therefore this freedom is in a vulnerable position. International instruments providing rights to freedom of movement have not been ratified by the UK. As explained below, the UK has not ratified the freedom of movement Protocols of the European Convention. Article 12 of the International Covenant on Civil and Political Rights 1976 provides protection for freedom of movement, but the UK entered a number of important reservations to this right on ratification. In any event, unlike the Convention, it is not enforceable as far as the UK is concerned by means of individual petition.
