ABSTRACT

In this chapter, we examine the procedure which takes place between conviction and the passing of sentence and at some of the factors which affect the sentence passed by the court.

For the first time, the objectives of sentencing have been enshrined in statute: s 142(1) of the Criminal Justice Act 2003 describes the purposes of sentencing, to which ‘any court dealing with an offender in respect of his offence must have regard’ as:

(a) the punishment of offenders,

(b) the reduction of crime (including its reduction by deterrence),

(c) the reform and rehabilitation of offenders,

(d) the protection of the public, and

(e) the making of reparation by offenders to persons affected by their offences.
