Where the tenant has ceased occupation before the end of the contractual tenancy, there will be no continuation tenancy. In the case of a periodic tenancy the landlord can therefore serve a notice to quit, and in the case of a fixed term tenancy the tenancy will end by effluxion of time. It is not necessary for the landlord to serve a s 25 notice in this situation. If a landlord is not sure about whether the 1954 Act has ceased to apply, it could still serve a s 25 notice, without prejudice to the fact that the 1954 Act does not apply.
