ABSTRACT

A party to a lease may be entitled to serve more than one notice at the same time. For example, a landlord who is entitled to bring the lease to an end prematurely by virtue of a break clause, can serve both a break notice and a s 25 notice together. In Keith Bayley Rogers and Co Ltd (A Firm) v Cubes Ltd (1975) 31 P & CR 412, it was held that the notices were delivered in the correct sequence, ie, the break notice first, then the s 25 notice, as the landlord had power to serve them in sequence.
