ABSTRACT

INITIATOR Mr Hezekiah Brown purchased a new car six months ago, from Auto Sales, for a substantial sum. There were continual problems with the car. The consumer has taken the car back to the dealer four times for the same problem, the car stalls for no apparent reason. When the car stalls, the power steering and brakes shut down. The consumer is handicapped due to a mild stroke and has difficulty walking. He has recently had his driver’s licence renewed after re-taking a performance test. Most recently, the car stalled along a highway and the consumer was stranded for over two hours until a truck driver offered assistance. The consumer now demands a new car or to have all his money refunded. He asked his attorneys, Tracy Smith & Co, to file an action in the Civil Jurisdiction of the Supreme Court against Auto Sales and a mediation has been scheduled through the Dispute Resolution Foundation.
