Introduction From the standpoint of the examination candidate, opinion evidence is a tricky subject to prepare.Your examiners may show little or no interest in it, so that an opinion point comes in, if at all, only as a minor part of a question dealing largely with other matters. On the other hand, it would be possible to devote a whole problem to the subject. It would even be possible – though surely not very interesting – to invite candidates to write an essay on some aspect of opinion evidence, for example, the current state of the so called ‘ultimate issue rule’. But let’s assume that you have ruled out the possibility of an essay question, or at least of doing it should one turn up. How should you cope with opinion evidence as part of a problem?
