ABSTRACT
Introduction The biggest obstacle to doing well in an evidence examination is failure to realise that this is very largely a practical subject, and that when you are faced with a problem question you need to think as carefully about the facts as about the law – perhaps even more carefully, because quite often what you think about the facts will affect the legal position. It would therefore be a good idea to make it a rule that you think about a problem question first as a story.
