ABSTRACT

Statements in furtherance of a common enterprise made by one party to the enterprise are admissible against others, even where they have had nothing to do with making the statement and may not know that a statement has been made. This rule is not confined to conspiracy cases; it applies wherever the prosecution alleges a joint enterprise. But the statement must have been made in furtherance of the enterprise, so it will not apply to the confession of one party after his arrest: Walters (1979).
