ABSTRACT

R v Human Fertilisation and Embryology Authority ex p Blood (1997): Gametes and embryos may only be stored and used with the donor’s consent Facts Shortly before his death and while he was in a coma, sperm was extracted from Mr Blood and placed in storage. After his death, Mrs Blood wanted to be impregnated with the sperm but the HFE Authority refused to grant a licence because there was no written consent from Mr Blood to allow his sperm to be stored and used. Mrs Blood sought a judicial review of the Authority’s decision.
