ABSTRACT
Experience has shown that trust and confidence in justice can be damaged where there is an over-reliance on confession evidence that ignores the importance of evidence available from questioning witnesses and victims. Confession-focused questioning can, and almost certainly does, lead to miscarriages of justice. This applies in both adversarial and inquisitorial jurisdictions but the legal framework can minimize or exacerbate the degree of reliance on confession evidence.
