ABSTRACT

Connecting the minimal and maximalist perspectives of gender differences in decision-making with aspects of the courtroom workgroup model, this chapter examines the impact of the gender of probation officers and judges on sentencing recommendations and actual judicial sentence of White and Black adult male offenders. It investigates the extent to which being a male or female probation officer impacts sentencing recommendations and judicial sentencing by White male judges and what these relationships entail concerning the treatment of Black male offenders compared to White male offenders. The race of the offender will not influence probation recommendations for female officers, but offender race will predict recommendations for male officers to the disadvantage of Black male offenders. The chapter presents the additive logistic regression results predicting probation officer recommendations and judicial sentencing decisions. The independent variables of interest in predicting probation recommendations are the gender of the probation officer and race of the offender.
