ABSTRACT

In the past two decades, nanotechnology has grown rapidly and is now poised for commercial takeoff in several fields leading to competitive posturing by the stakeholders. Being essentially technology-led, the key to leadership is strategic management of patent portfolios. It is therefore not surprising that battle lines have been drawn in the patent landscape to establish dominating positions through painstaking patent portfolio building, challenging validity of patents, enforcing patent rights, striking deals as an integral part of patent litigations, questioning contracts, and initiating proceedings based on competition law/antitrust laws.
