ABSTRACT

THE FOLLOWING IS A BRIEF SUPPORTING A MOTION TO DISMISS CHARGES AGAINST the author, Russell Means, Glenn T.Morris, and Cahuilla Red Elk (a.k.a., Margaret Martinez), principal leaders of the American Indian Movement of Colorado, for having halted a Columbus Day celebratory parade near the Colorado State Capitol Building in Denver, on October 12, 1991. Having stopped the parade for approximately forty-five minutes, the defendants-supported by more than three hundred other protestors-refused police directives to remove themselves from the street until we were arrested. The four of us were then charged with refusing to obey a lawful police order, obstructing a public thoroughfare, and disturbing the peace, offenses carrying a combined potential of two years incarceration.
