ABSTRACT
This chapter explains the various forms of prior restraint such as injunctions, prepublication agreements, military security review, licensing and discriminatory taxation. The chapter also explains why the Supreme Court generally disfavors licensing but allows licensing in special contexts such as broadcasting. Punishment after publication is also discussed. Finally, this chapter presents the Supreme Court’s tests for determining the constitutionality of content-neutral regulations.
