The only means whereby a local authority can assume parental responsibility is by means of a care order made by a court, on the basis that the threshold conditions are satisfied and that the order is likely to contribute positively to the child's welfare. If a court does not find the threshold conditions satisfied, it may not make a care or supervision order. Prior to a final hearing, an interim care order or supervision order or any private law orders under section 8 of the Act may be made on the basis that there are reasonable grounds to believe that the threshold conditions exist. No care order may be made with respect of a child until the court has considered a section 31A care plan. A supervision order, which does not give the local authority parental responsibility, puts the child under the supervision of a designated local authority for up to one year.
