ABSTRACT

The significance of Electromation, Inc., 309 NLRB 990 (1992), enfd. 35 F.3d 1148 (7th Cir. 1994), while appreciated by many, has depreciated over time, due in part to legislative wrangling, prosecutorial politics, and, more recently, anecdotal reports that some employee involvement activities may not always deliver. Why is this so? Is a different result important? Can a better outcome still be realized? To answer these questions, a little history may help.
