ABSTRACT

Introduction This chapter considers in detail the Treaty provisions concerning the non-fi scal barriers that may impede the free fl ow of goods between Member States. A Member State may be concerned about the health risk posed by produce from another state and may wish to impose a ban or quota on such goods. This may be justifi ed if the Member State can prove that such a restriction is necessary and justifi ed. This chapter outlines both successful and failed attempts at such restrictions.
