ABSTRACT

Some prominent issues within the scope of today’s Cyberlaw discussion are about Cybersecurity, Privacy, and Identity, particularly the National Electronic Identity Management in e-transactions. Identity has a great value as authentic information in representing personal data. In practice, there are many digital identities that may be used by people in the market. Even though there are many countries implementing a single credential system in their National e-ID Management, they actually cannot deny the existence of many online identities in the society that have already been used and accepted by the public in the market. Therefore, in order to support regional e-commerce, some countries inevitably should accommodate federated identity management in their policy. It may be classified as a critical public infrastructure in Cyber security. Through the normative research and methods of the qualitative data analysis by studying some lessons learned from the US-National Strategy for Trusted Identity in Cyberspace (NSTIC) and the European Regulation No. 910 of 2014 regarding e-Identification and Trust Services, this paper aims at recommending the National legal framework for trusted identity ecosystem and/or the e-Authentication System in Indonesia to support e-transaction in a regional context, ASEAN Economic Community.
