ABSTRACT
Over the past decade in England and Wales, as in many other jurisdictions, there have been substantial developments in the legal rules relating to mentally incapadty. These include both an increased clarity about the way in which incapacity is determined and fairer and more sophisticated guidance on the way in which decisions should be made for those who are deemed to be mentally incapable.
